These Terms of Use ("Terms") are an agreement between you and DEESTECH HOLDINGS LLC ("Naymi", "we", "us") governing your use of the Naymi website and apps (the "Service"). By using Naymi, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use Naymi. If you are under the age of majority where you live, you may use Naymi only with the involvement of a parent or guardian.
Naymi lets you record the pronunciation of your own name, automatically enhances the audio, and — at your choice — publishes it with a shareable link and code and, optionally, in a public directory of self-recorded names.
You own your content. The recording, name, phonetic spelling, photo, and description you create ("Your Content") remain yours.
License to operate the Service. When you publish Your Content, you grant Naymi a worldwide, non-exclusive, royalty-free license to host, store, reproduce, stream, display, and distribute Your Content solely to provide and operate the Service — for example, to store your recording, generate your link and code, play it back to people you share it with, and show it in the directory where you have chosen to publish. This license ends when you delete Your Content, except for copies already shared by others or retained as required by law or in routine backups for a limited period.
Your promises. You represent that Your Content is of your own name and voice (or that you have the necessary rights and consent), and that it does not infringe anyone's rights or violate any law.
You agree not to use Naymi to:
Content you publish is intended to be shared and can be accessed by anyone with the link or code, and may appear in the public directory. Do not publish anything you would not want to be public.
If you believe content violates these Terms or your rights (for example, someone published a recording of you without consent, or infringed your intellectual property), contact us at privacy@naymi.app and we will review it. We may remove content or suspend access at our discretion, particularly content that violates these Terms.
The Naymi name, logo, software, and design are owned by DEESTECH HOLDINGS LLC and are protected by applicable laws. These Terms do not grant you any right to use our brand or software except to use the Service as intended.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, DEESTECH HOLDINGS LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).
You agree to indemnify and hold DEESTECH HOLDINGS LLC harmless from any claims, damages, or expenses arising from Your Content or your violation of these Terms.
You may stop using Naymi and delete Your Content at any time. We may suspend or terminate access to the Service for conduct that violates these Terms or harms the Service or other users.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Any dispute will be subject to the courts located in New Jersey, unless applicable law provides otherwise.
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Continued use of the Service after changes means you accept the updated Terms.
